General Terms and Conditions (GTC) – HofaBäck Bakery

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed by private customers (B2C) and commercial customers (B2B) through our online shop www.angelhairchocolate.shop . By placing an order, you agree to these GTC.

3. Offers & Conclusion of Contract

Our offers in our online shop are non-binding. A contract is only concluded when we accept your order via email or shipping confirmation .

We reserve the right to refuse orders, particularly in the following cases:

• Unavailability of the goods
• Discrepancies in payment
• Suspicion of commercial resales without B2B conditions

4. Prices & Payment Terms

All prices are final prices in euros (€) and include VAT.

Prepayment (bank transfer)

For B2B orders over 500 pieces , a 50% deposit is required , the remaining amount is due before shipment.

5. Shipping & Delivery

Private customers (B2C)

• Shipping countries: Austria & selected EU countries
• Delivery time: 2-8 working days depending on the country
• Shipping costs: from 4.90 € (Austria)

Commercial customers (B2B)

• Delivery time: 5-10 working days (unless otherwise agreed verbally)
• Shipping costs:
  • 100 pieces: 39 €
  • 300 pieces: 89 €
  • 2,500+ pieces: €289

Important note: We are not liable for delays or transport damage caused by shipping service providers .

6. Right of withdrawal & return (B2C)

Since these are foodstuffs , a right of withdrawal is excluded according to Section 18 FAGG .

Complaints must be reported within 48 hours of receipt by email to leberbauer@hofabaeck.at , including photos.

7. Warranty & Liability

We guarantee the highest quality of our products. Should an item be defective, the statutory warranty rights apply.

Exclusion of liability:

• We are not liable for damage caused by improper storage (e.g. direct sunlight, heat).
• No liability for delivery delays caused by third parties (post office, customs).

8. Data protection

Your data will be treated confidentially in accordance with the GDPR . It will only be shared with third parties for order processing (e.g., shipping service providers, payment providers) . Further information can be found in the privacy policy section.

9. Allergens & Product Information

Our products contain:

⚠️ May contain traces of sesame, peanuts and hazelnuts.

10. Final provisions

Austrian law applies. The place of jurisdiction is Salzburg .

Our handmade chocolate bars contain the following allergens according to the EU Food Information Regulation (LMIV):

Important NOTE:
Our products are manufactured in a bakery that also processes other nuts, sesame, and gluten-containing ingredients. Despite the utmost care during production , traces of allergens cannot be ruled out.

Shipping guidelines – HofaBäck Bakery

1. Shipping countries & delivery times

We ship our handmade chocolate bars within Austria and selected EU countries .

Private customers

📦 Free shipping for orders over 50 € (only within Austria)

⚠️ Note for hot summer months:
Chocolate is delicate! During the summer months, we ship exclusively from Monday to Wednesday to avoid prolonged storage in warm parcel centers.

B2B shipping costs & delivery times

• Special packaging for bulk orders: Due to the delicate nature of our chocolate, we use high-quality protective packaging to prevent breakage or melting.
• Express or pallet shipping: Available upon request.

📦 Individual logistics solutions & special prices for very large quantities on request.

2. Shipping service provider

• Private customers: Austrian Post, DHL or DPD
• B2B: Shipping via freight forwarder or individually coordinated delivery service

As soon as the package leaves our premises, you will receive a tracking number via email.

3. Packaging & Freshness Guarantee

• Each chocolate bar is carefully packaged to prevent breakage and melting .
• For larger orders we use special protective packaging .
• In summer we use insulated packaging and cooling pads (on request and for an additional charge).
• Shelf life: At least 3 months from dispatch.

4. Payment & order processing

Private customers (online shop)

Orders will be processed within 1-2 business days after receipt of payment.

  • From 500 pieces : 50% deposit required , the remaining amount must be paid online before shipping.

5. Returns & Complaints

Since these are food products , returns are generally not possible. If your order arrives damaged or faulty, please contact us within 48 hours of delivery with photos by email to: order@angelhairchocolate.shop
